non fault motorway crash...out of pocket after insurance payout

Hi.

Six weeks ago I was wiped out on the motorway by a car that had a blow out. Long story short I ended up on my roof facing the wrong way, and I am lucky to escape with minor injuries.

The car was written off and I recieved a cheque from my insurer. Not enough to replace my vehicle outright.
I bought a second hand vehicle with my own additional savings and because of the snall budget I had, the new car needs work too...at my cost. Also there is alot of pressure to rush buying another car when you only have a hire car for 7 days after you get the cheque.

I have legal injury claims solicitors DLG and they say I can claim out of pocket expenses due to the crash...but they say that the difference between the shortfall in insurance payout and buying a new car does not count as expenses.

However I strongly disagree since I wouldnt be in this position spending my savings if it wasnt for the crash.

Is there anyway I can claim for this extra expense which is not my own doing?
